SPRINGFIELD, MISSOURI (November 6, 2020) – Johnson & Associates obtained an outright dismissal of all Defendants’ counterclaims from the U.S. District Court for the Western District of Missouri. Christopher Johnson and Robert Freehill represent a commercial leasing company involved in a multi-party federal lawsuit based on claims that the Defendants (1) breached a commercial lease agreement related to commercial beverage production and bottling equipment and (2) breached a settlement agreement related to the same equipment. The Defendants filed counterclaims and third-party claims against Johnson & Associates’ clients for fraud, fraud in the inducement, tortious interference with a business expectancy, abuse of process, breach of contract, and estoppel. Johnson & Associates filed motions to dismiss all Defendants’ asserted counterclaims. On November 6, 2020, the Honorable M. Douglas Harpool, U.S. District Judge, granted Johnson & Associates’ motions and dismissed all Defendants’ counterclaims. Defendants were seeking more than $100 million in damages through their counterclaims.
