Johnson & Associates Prevail in Jury Trial Enforcing Employee Non-Compete Agreement

Galveston County, Texas (July 8, 2022) – Johnson & Associates obtained a favorable jury verdict in the 56th District Court of Galveston County, TX. Partner Christopher Johnson and Senior Associate Attorney Morgan Jenkins represented a local corporation to enforce their Non-Disclosure, Non-Compete, and Non-Solicitation Agreement after a key employee left the corporation to work for a direct competitor and asserted claims that the ex-employee (1) breached her contract with the corporation and (2) misappropriated trade secrets of the corporation to unfairly compete. The Defendant asserted counterclaims against Johnson & Associates’ client alleging (1) that the Non-Disclosure, Non-Compete, and Non-Solicitation Agreement was unenforceable and (2) that the Plaintiff tortiously interfered with Defendant’s new employment. During the litigation process Johnson & Associates overcame multiple motions for summary judgment filed by Defendant and prevailed on their own Motions for Summary Judgment, resulting in the Court ultimately ruling that the Non-Disclosure, Non-Compete, and Non-Solicitation Agreement was an enforceable contract as a matter of law. The case came to an conclusion when Johnson & Associates attorneys presented their client’s case to a panel of twelve jurors over a period of four (4) days. On July 07, 2022, the jury returned a verdict granting all of Johnson & Associates’ client’s claims, denying all of Defendant’s claims, and awarding Johnson & Associates’ client attorneys’ fees in the amount of $310,107.00.
